SECTION 166 (1) (D)

 

 

Implemented for the application of Title Release Documents (DHK) lost / damaged / wholly or partly damaged.

 

 

Replacement of Title

SECTION 175 A-F

 

A method for replacing the lost Register Document Title (DHD), destroyed wholly and partly or information recorded is unreadable.

It should be implemented in order to update ownership records and for the purpose of conserving DHD that have been damaged.

Landowners must work together to submit DHK for the purpose of reviewing its endorsement records and previous land dealings.

 

 

Duplicate Title

 

 

DHK to replace lost, damaged, full page or physical its condition which cannot be used again.

DHK will also be issued if the land owner refused to surrender despite receiving notice DHK Form 2B Section. 15 NLC

 

 

APPLICATION FOR CONTINUATION OF TITLE DUE TO DKH IS LOST/DAMAGED/WHOLLY OR PARTIALLY DESTROYED

1.     What is meant by DHK missing / worn out / partly damaged??

·         DHK can be categorized as lost when the document is not in the possession of the landowner due to misplaced, stolen, accidently drop, natural disaster and so fourth..

·         DHK can be categorized as damaged and destroyed partly or wholly when DHK is still in the possession of the owner or interested person but its physical condition has been damaged or destroyed and are no longer suitable to be stored.

      2.  Who is eligible to apply for this?

·         The registered land owner

·         Stakeholders, namely the chargee and lienholder's caveat

·         The heirs of the owner of registered land

·         Individuals who have been appointed by a company / organization / association through a resolution or extracts of the minutes of meetings

·         Individuals who have received a power of attorney to execute this application

·         Statutory Declaration is not required for the application of continuation of DHK title due to damage.

3.     What are the documents to be submitted with the application?

 

·         Statutory Declaration (original) of each of the owners and stakeholders of the land are required for the application of missing title, andpolice report (original) in respect of such loss of the title document. A copy of the Death Certificate of the ownerBirth Certificate of the heir,authorized letter as the administrator is necessary for the application of the landowner's heirs. Letter of appointment / a copy of resolution /extract of minutes of meeting and establishment of LawM & A for an application made by a company organization/ association. The damaged DHK is required to be submitted for an application of continuation of the title due to damaged / either wholly or partially destroyed.
