REGISTRATION OF DEALINGS AND NON DEALINGS

 WHAT IS DEALINGS?

Section 5 NLC define dealing as:

“Any dealings in respect of alienated lands effected under the powers conferred by Division IV *, and any similar dealings effected under the provisions of any law of the land earlier, but does not include any caveat or prohibitory order.”

 [*Divisyen IV – Re-alienation of Lands; Dealings; Section 205 – 339 KTN]

 TYPES OF DEALINGS

Dealings which do not require registration:

Lien [Sec. 281] – not necessary to register but the Lien Caveat holder’s can enter the Lien Caveat by submitting Form 19D and issuance of document title together with the registration fee to protect its interests.

Dealings which are not necessary to register:

Free Rental Registry or the Tenancy exempted from registration [Sec. 213] - does not require to be registered but the holder of the tenancy (tenant) may apply to be listed in a claim of title documents to protect its interests by submitting a copy of the rental agreement / tenancy and registration fees 

NON DEALINGS TYPE

Submission business/the Form can be registered under NLC apart from instrument transaction which is known as Non-Transaction business.  Type of Non-Transation business that can be registered among which are mentioned as follows:

d) Resolution, Form 49 and the Company’s M & A to determine on the implementation of the instrument with perfect form and eligibility of land business.

e) Approval letter for loose restrictions.

f) Approval letter from the State Authority for land acquisition and other Non-Citizen / Foreign Companies

g) Certificate of Transfer from the Board of Farmland

h) Letter of Approval by Caveator

i) Letter of Approval from Chargee

j) Copy of Court Order

k) Letter of Offer for low cost house/medium cost house

l) Letter for Relinquishment of Bumiputera Lot

m) Probet Grant/Power of Attorney to Administer

n) Statutory Declaration

Registry of Land Title in Johor, submission of transaction instrument/non-transaction form for registration in this office may be submitted together with the required documents and a fixed registration fee either through its Submission Counter at the Division of Registration of Title, i.e. Level 1, Building Land and Mines Office, Kota Iskandar, Nusajaya during office hours or by mail to the following address:-

 Submission by mail should attached together payment by Money Order, Postal Order or Bank Draft/Lawyer’s Cheque in favour of DIRECTOR, JOHOR LAND AND MINES

SUBMSSION OF INSTRUMENT/FORM AT THE COUNTER:

Sunday to Wednesday   :  8.15 am to 12.30 pm and 2.00 pm to 4.30 pm

 

Thursday                      :  9.00 am to 2.00 pm
