WHAT ARE THE VALID COPY, OFFICIAL SEARCH AND PRIVATE SEARCH?
A Valid Copy (Section 383, NLC)
A certified copy of a document of title or dealing instruments are registered in the storage Registry's Office / Land Office which each certified copy shall be signed and sealed by the Registrar and accepted by any Courts or Judge or any legislative body having the power to investigate or make a decision on any matter in evidence 'prima facie' for all contained inside it or endorsed on it.
Official Search of Title (Section 385, NLC)
An official search of the certificate signed and sealed by the Registrar is to ensure that the content shows the information of title, ownership and other related matters which are still effected as recorded in the registered document of title and record of dealings / non-dealings that have not been received but not yet registered.
Private Search (Seksyen 384, KTN)
A private search to gain information by any individual by examining and taking notes or quotes:
(a) Any list of titles, Presentation Book or Notebook Corrections maintained by the Registrar or any precursor of the Registrar; and
(b) any instrument dealings or application submitted to or in the custody of the Registrar.
THE INFORMATION AVAILABLE FROM A VALID COPY, OFFICIAL SEARCH AND PRIVATE SEARCH
(a) for obtaining the name of registered land owner.
(b) for obtaining the land information such as:
i. Catergory of land use
ii. Interest restriction
iii. Lease Period - Area of land
- Rate of land tax
- Actual Terms and Conditions
vii. Transfer information, Charge, Cavert and others
To obtain information from the providers and recipients who will executed the instrument.
